Shanise Hussain, of West Drive, Handsworth, appeared at Birmingham Crown Court on Thursday, September 3, 2026, where she was sentenced for causing death by dangerous driving. In addition to her custodial sentence, the court imposed a driving disqualification period of eight years and three months.

The fatal collision occurred on Great Hampton Street, Hockley, at approximately 2:45 pm on Sunday, July 21, 2024. As reported by Nick Horner, Senior Reporter at the Birmingham Mail, and corroborated by court reporting from ITV News Central, victim Maurice Middleton, aged 65, was killed after being struck by Hussain’s Audi A3 while walking along the footway. Mr Middleton had briefly left his home to purchase a newspaper and cigarettes for his wife whilst she prepared dinner, but never returned.

How Did the Fatal Collision Occur on Great Hampton Street?

According to details released by West Midlands Police and reported by Nick Horner of the Birmingham Mail, Shanise Hussain was travelling along Great Hampton Street in an Audi A3 at 48 mph in a designated 30 mph zone.

As Hussain proceeded down the road, a Jaguar vehicle positioned in the nearside lane indicated and shifted into her lane suddenly. In response, Hussain swerved sharply to avoid a collision, crossing onto the opposite side of the road. The wheels of her Audi struck the central reservation.

At this point of lost vehicle stability, Hussain inadvertently depressed the accelerator pedal rather than the brake pedal. This caused the vehicle to accelerate onto the pedestrian pavement, striking two individuals. The impact threw Mr Middleton against a shop front, causing fatal injuries. Emergency medical services attended the scene, but Mr Middleton was pronounced dead at the location. The second pedestrian struck during the incident sustained minor head and hand injuries. A parked vehicle was also damaged during the collision sequence.

What Were the Findings of the Police Investigation and Court Proceedings?

As reported by Katy Hallam, Audience Editor at Birmingham Live, and ITV News Central, Hussain remained at the scene following the incident to co-operate with police officers. She was formally interviewed at a later date and subsequently charged with causing death by dangerous driving, an offence for which she was found guilty at a court hearing earlier in the year prior to sentencing on September 3.

The legal proceedings also addressed the role of the secondary motorist involved in the initial vehicle interaction. As detailed in police statements cited by the Birmingham Mail, the driver of the Jaguar that executed the sudden lane change in front of Hussain’s Audi was previously prosecuted and convicted of careless driving in connection with the incident.

How Have the Victim’s Family and West Midlands Police Responded?

Following the sentencing hearing at Birmingham Crown Court, West Midlands Police released a tribute on behalf of Mr Middleton’s family.

As published by ITV News Central, the family of Maurice Middleton expressed their profound grief in a statement:

“Maurice was a brilliant, kind and generous man who was loved by everyone that he met. His death has completely shattered us as a family. He was our rock; our king and he is truly loved and missed so much every day. Maurice was the centre of our family, the glue that held us all together and that is why his death has completely devastated us because it has left such a big hole in our hearts that nothing and no one can ever fill.”

Additionally, as reported by Nick Horner of the Birmingham Mail, Detective Sergeant Richard Evans, from the West Midlands Police Serious Collision Investigation Unit, emphasized the grave responsibilities of all motorists:

“This was a devastating incident which resulted in the loss of a life. Our thoughts are first and foremost with the victim’s family, who have been supported by specially trained officers throughout this extremely difficult time. I would take this opportunity to remind all road users of the responsibility they carry every time they get behind the wheel. The decisions made in a moment can have life-changing consequences for many people.”

Background of Road Safety and Speed Enforcement Developments in Birmingham

This judicial outcome follows sustained public and administrative focus on urban road safety within the West Midlands region. Great Hampton Street, located in the Hockley area near Birmingham city centre, forms a key arterial route characterized by a mixture of commercial shop fronts and pedestrian walkways.

Over recent years, West Midlands Police and local authorities have intensified enforcement against urban speeding through expanded camera networks and targeted operations by the Serious Collision Investigation Unit. The legal precedent enforced in this case underscores two critical standards under UK traffic law: driver accountability for excess speed regardless of third-party actions, and the distinct criminal liabilities assigned to primary and contributing drivers involved in multi-vehicle incidents.

Prediction: How This Judicial Development Will Affect Local Road Users and Policy

The imprisonment of Shanise Hussain and the accompanying conviction of the secondary driver set a clear precedent that is anticipated to impact local road users, legal frameworks, and traffic policy across the West Midlands in several distinct ways:

  • Impact on Local Motorists and Driving Behaviour: The imposition of a four-and-a-half-year custodial sentence alongside an eight-plus-year driving ban serves as a strong deterrence against speeding on urban roads. Driver awareness regarding the legal definition of “dangerous driving” will likely heighten, reinforcing that unexpected actions by other vehicles (such as sudden lane changing) do not legally negate a speeding driver’s primary responsibility for maintaining vehicle control.
  • Increased Police Enforcement on Urban Arterials: Following public statements from the Serious Collision Investigation Unit, West Midlands Police are expected to maintain rigorous enforcement of 30 mph zones along major commercial thoroughfares like Great Hampton Street. Drivers can anticipate increased deployment of mobile speed enforcement units in built-up pedestrian areas.
  • Policy and Infrastructure Considerations: Local community advocate groups and urban planning authorities in Birmingham may utilize the findings of this case to press for infrastructure modifications. These may include enhanced central physical barriers, traffic-calming measures, or revised speed limit signage along mixed-use corridors to prevent vehicle mounting onto footways in emergency braking scenarios.
